Florida Consumer Collection Practices (the “FCCPA”)
Creditors (e.g., banks, credit card companies, cell phone providers, landlords, etc.) are not allowed to send you certain e-mail communications between the hours of 9:00 PM and 8:00 AM.
Any e-mail you received between 9:00 PM and 8:00 AM from a creditor may violate your rights under the Florida Consumer Collection Practices Act (FCCPA).
An aggrieved consumer may be entitled up to $1000 in statutory damages if your rights under the FCCPA have been violated.
The most common violations are:
- Payment is due reminder
- Payment is past due notice
- Auto pay notice
- Statement ready
- Any Bill
- Credit Card Company Statement
- Utility company
- Subscriptions
- Other communications related to a debt. If you have a relationship where you may owe them money then they may be covered.
- If you pay them money then they may be responsible
