Fair Debt Collection Practices Act (the “FDCPA”),

The Fair Debt Collection Practices Act (FDCPA) protects consumers from many forms of debt collectors’ harassment. An aggrieved consumer may be entitled up to $1000 in statutory damages, plus actual damages per violation.

The most common violation are:

  • Failing to disclose the creditors’ identity
  • Using false, misleading, or deceptive practices during the collection of a consumer debt
  • Attempting to Collect on the wrong amount
  • Providing an incorrect balance breakdown
  • Making false threats of litigation or of criminal prosecution
  • Failing to adequately disclose interest accruing or attempting to collect interest, fees, or collection costs, where they are not due under the law or by contract.
